If your company participates in the Medicaid program your minimum limits are listed above, however if you provide services to a nursing home or other social service agency a greater amount of liability coverage may be necessary.

The final question that should be considered is the size and financial strength of your company.  Why is this important?

Let’s assume a NEMT Company’s revenues exceed $1 million per year and they exclusively work under the Medicaid program.  Would a $100,000 liability limit per person be sufficient to protect the ongoing revenue stream of a business earning over $1 million per year in the event of a significant claim event?

No.

The chances of accident increase exponentially simply for the fact more miles are driven by commercial vehicles.

What if an accident was caused by a driver employed by the NEMT company resulting in a $200,000, $500,000, or $1,000,000 claim and the NEMT company was deemed liable?

The insurance company would pay their maximum selected amount of $100,000 to the injured party.  The remaining amount would be the responsibility of the NEMT company itself.

It’s best to consult with your legal advisor to help you determine the amount of coverage you need to protect your business financially as the minimum amount required by lay may be insufficient.
