NEMT Insurance New Orleans Louisiana — Why Few Carriers Offer This Insurance Part 4.

In our previous post we began to discuss why it’s so difficult to find insurers willing to provide NEMT Insurance in Louisiana and across the country.

The simple reason is based on the fact there is more exposure for liability claims for Non-Emergency Medical Transportation Companies versus a traditional business such as a contractor.

To highlight this fact, we shared a hypothetical situation examining a claim between a HVAC Contractor versus a Non-Emergency Medical Transportation Company involving the work vehicle hitting a minivan.

Let’s summarize what happened with our NEMT Company.

Stan works as a driver for Old Foggy Nonmedical Transport and as he is driving two elderly passengers to their doctor’s appointment, Ms. Jones and Mrs. Stone,

Stan is distracted by a phone conversation he was having with his ex-wife over a child custody issue.

Stan takes his eyes off the road for only a moment or two when he fails to notice a minivan suddenly stopped in front of him. Stan slammed on his brakes but it was too late!

Stan’s passenger van slams into the back of another van going about 20 miles per hour.

Stan walks away without a scratch thanks to his seatbelt and the airbag deploying but his passengers are not so lucky.

Both of his passengers are injured, Mrs. Stone more severely than Ms. Jones and two of the four passengers in the minivan Stan hit are also insured, a total of 4 are transported by life squad to the hospital.

After 1 year of back and forth negotiations between the 4 injured parties (2 in the minivan and 2 elderly passengers in Stans van) plus a lawsuit filed against Old Foggy Nonmedical Transport due to Mrs. Stone’s severe injuries, here is what everyone received as final settlements:

The passengers in the minivan Stan ran into who were injured, Jamie Stallworth, aged 19 a college student who had her collarbone broken was awarded $14,000 to cover the medical expenses and $5,000 for pain and suffering.

Jamie’s dad Eric settled for $31,000 for his broken arm, which included payment for medical expenses and his loss of wages for 9 weeks as he could not drive his tractor due to his broken arm plus pain and suffering.

Here is where it super got expensive for Old Foggy Nonmedical Transport’s insurance company.

Ms. Jones received a payment of $47,212 to care for her injuries and rehab with nearly $30,000 for pain and suffering, her attorney got 33% of the settlement.

Barry, Mrs. Stone’s attorney made out quite well with his contingency because he filed a lawsuit against Old Foggy Nonmedical Transport for her injuries which were quite severe.

Mrs. Stone broke a number of bones, including her hip, in the car accident as she was ejected from the van, the seat belt failed to restrain her when the accident occurred.

Mrs. Stone’s attorney Barry was able to secure a $700,000 settlement for medical and pain and suffering.

In our next post we will examine this accident and compare it to the accident for the HVAC company so it is crystal clear for our reader’s why Louisiana NEMT Insurance is so much riskier for insurers versus other lines of business they may offer.
